Terms of Service

Welcome to Jackie. These Terms of Service explain the rules that apply when you use Jackie's website, mobile app, booking tools, delivery services, charter services, ride services, partner features, and related support services.

By creating an account, placing a booking, becoming a partner, or using Jackie in any way, you agree to these Terms. If you do not agree, you should not use Jackie.

1. Who We Are

Jackie is a Jamaica-focused mobility and delivery platform that helps people and businesses request services such as:

• Package delivery
• Store pickup
• Courier and relay services
• Bike-based delivery
• Charter transportation
• Ride bookings
• Business deliveries
• Future services such as food, groceries, pharmacy delivery, marketplace shopping, and courier integrations

Depending on the service, Jackie may either provide the service directly or connect you with an independent driver, rider, courier, charter operator, merchant, or other service partner.

Unless Jackie clearly states otherwise in the app or website, Jackie operates as a platform that helps arrange bookings, payments, communication, tracking, and support.

2. Eligibility

You must be at least 18 years old to create an account, place a booking, become a partner, or use Jackie's paid services.

By using Jackie, you confirm that:

• You are legally able to enter into these Terms.
• The information you provide is true and current.
• You will use Jackie only for lawful purposes.
• You will follow these Terms and any service-specific rules shown before booking.

3. Your Jackie Account

To use certain Jackie services, you may need to create an account.

You are responsible for:

• Keeping your login details secure
• All activity that happens under your account
• Updating your phone number, email, payment details, and account information
• Contacting Jackie immediately if you believe your account has been accessed without permission

Jackie may request identity, contact, payment, or verification information before allowing access to certain services.

4. Jackie Services

Jackie may allow users to request different types of services, including delivery, pickup, rides, charters, business services, and partner services.

Service availability may vary by location, time, partner availability, vehicle availability, weather, safety conditions, public holidays, road conditions, or legal and operational requirements.

Jackie may add, remove, limit, suspend, or change services at any time.

5. Bookings

A booking request is not confirmed until Jackie confirms it in the app, website, or official communication channel.

When you place a booking, you agree to provide accurate details, including:

• Pickup location
• Drop-off location
• Contact details
• Recipient details, where applicable
• Package or item description
• Passenger details, where applicable
• Preferred date and time
• Any special instructions

Estimated pickup times, delivery times, arrival times, and journey times are estimates only. Actual times may vary.

6. Delivery and Package Pickup

For deliveries and pickups, you are responsible for making sure the item is properly prepared, safely packaged, and ready for collection.

You agree not to send items that are illegal, unsafe, restricted, dangerous, or unsuitable for transport.

Jackie may refuse, cancel, or stop a delivery if the item appears unsafe, unlawful, incorrectly described, poorly packaged, or outside the service type selected.

7. Prohibited Delivery Items

You must not use Jackie to send, transport, or request collection of:

• Illegal goods
• Weapons, ammunition, or explosives
• Dangerous, flammable, or hazardous items
• Cash or negotiable instruments, unless Jackie expressly allows it
• Stolen goods
• Controlled substances
• Items requiring special permits unless properly approved
• Live animals
• Fragile, perishable, or high-value items unless declared and accepted
• Items that may damage a vehicle, rider bag, driver, rider, recipient, or other goods

Jackie may update this list at any time.

8. Delivery Completion

A delivery may be treated as completed when the item is delivered to:

• The named recipient
• Someone reasonably appearing authorized to receive it
• Building security, reception, or front desk
• A location approved by the sender or recipient
• Another delivery point confirmed through the app or support channel

Jackie may use photos, signatures, delivery codes, location records, support notes, or app confirmations as proof of delivery.

9. Charters and Rides

Jackie may allow users to book rides, charters, airport transfers, business travel, event transportation, scheduled trips, or other passenger transport services.

When booking a charter or ride, you agree to:

• Enter accurate pickup and destination details
• Be ready at the agreed pickup point
• Respect the driver and vehicle
• Wear a seatbelt where required
• Follow reasonable safety instructions
• Avoid unsafe, unlawful, abusive, or disruptive conduct

Drivers and charter partners may refuse or end a trip where safety, legal compliance, or serious misconduct is a concern.

10. Passenger Conduct

You must not:

• Harass, threaten, insult, or abuse a driver, rider, partner, merchant, customer, or Jackie staff member
• Damage a vehicle or delivery equipment
• Carry illegal or dangerous items
• Ask a driver or rider to break the law
• Smoke or vape in a vehicle unless expressly allowed
• Consume illegal substances during a trip
• Exceed passenger, baggage, or vehicle limits
• Interfere with safe driving or riding

Jackie may charge cleaning, damage, waiting, cancellation, or support fees where reasonably required.

11. Prices and Fees

Prices may include:

• Base fare or service fee
• Distance charges
• Time charges
• Waiting time
• Delivery fee
• Charter fee
• Pickup fee
• Cancellation fee
• Return or re-delivery fee
• Taxes or government charges
• Tolls, parking, or access fees
• Special handling fees
• Partner or merchant fees
• Tips, where available

Prices shown before booking may be estimates. Final charges may change if the pickup point, destination, route, waiting time, package details, vehicle type, or service conditions change.

12. Payments

You agree to pay all charges linked to your booking.

Jackie may use third-party payment providers to process payments. Payment provider terms may also apply.

By adding a payment method or confirming a booking, you authorize Jackie and its payment partners to charge, pre-authorize, adjust, refund, or reverse payments where needed to complete the service, correct an error, process a refund, handle a dispute, or prevent fraud.

Cash may only be accepted where Jackie clearly offers cash payment for that service.

13. Cancellations

You may cancel a booking through the app or approved support channel.

A cancellation fee may apply if:

• A driver or rider has already accepted the request
• The partner is already on the way
• The partner has arrived
• The service has already started
• Jackie or the partner has already incurred costs
• The booking is a scheduled charter, airport transfer, or time-specific service

Cancellation rules may differ by service type and will be shown where applicable.

14. Refunds

Refunds may be issued where required by law, where Jackie confirms that a service was not provided, or where Jackie decides a refund is appropriate after review.

Refunds may not be available where:

• Incorrect booking details were provided
• The sender, recipient, or passenger was unavailable
• The item was not ready for pickup
• The delivery failed because of customer error
• The customer cancelled after the service had started
• A prohibited item was involved
• The service was completed as requested

Nothing in these Terms limits any rights you may have under applicable Jamaican law.

15. Failed Pickup, Failed Delivery, and No-Show

A booking may be treated as failed if:

• The pickup contact is unreachable
• The recipient is unavailable
• The passenger does not arrive
• The address is incorrect or incomplete
• The item is not ready
• The item cannot be safely or legally transported
• The driver or rider is unable to access the location

Jackie may charge reasonable waiting, return, re-delivery, cancellation, or support fees.

16. Business and Merchant Services

Businesses may use Jackie to arrange customer deliveries, store pickups, fulfilment, courier requests, employee transportation, client transportation, or other business services.

Business users are responsible for:

• Providing accurate order and customer details
• Making items ready for pickup
• Ensuring products are lawful and suitable for delivery
• Handling product quality, warranties, substitutions, and customer-facing product issues
• Complying with applicable business, consumer, tax, and product laws

Jackie is not responsible for the quality, safety, accuracy, or legality of products sold by merchants unless Jackie expressly states otherwise.

17. Jackie Partners

Jackie partners may include drivers, riders, couriers, charter operators, merchants, and other independent service providers.

Partners are responsible for:

• Holding required licences, permits, insurance, and approvals
• Keeping vehicles and equipment safe and roadworthy
• Following applicable laws and regulations
• Completing accepted requests professionally
• Treating users respectfully
• Protecting user information
• Following Jackie's partner rules and service standards

Jackie may suspend or remove partners who breach these Terms, fail verification, provide unsafe service, or create risk for users or the platform.

18. Safety

If there is an emergency, contact local emergency services first.

Jackie may contact users, partners, emergency contacts, insurers, regulators, law enforcement, or other relevant parties where reasonably necessary to protect safety, investigate incidents, prevent fraud, comply with law, or resolve disputes.

19. Promotions, Discounts, and Credits

Jackie may offer promotions, discounts, referral credits, coupons, or account credits.

These offers may be limited by:

• User
• Location
• Service type
• Time period
• Minimum spend
• Payment method
• Availability
• Other rules shown with the offer

Promotions have no cash value unless Jackie states otherwise. Jackie may cancel, withhold, or reverse promotions if misuse, fraud, or error is suspected.

20. App, Website, and Platform Use

You may not:

• Copy, resell, or misuse Jackie's platform
• Attempt to access systems without permission
• Scrape, harvest, or extract platform data
• Interfere with app or website security
• Upload harmful code
• Create fake accounts
• Abuse promotions or referrals
• Use Jackie for fraud, harassment, illegal activity, or unsafe conduct
• Misrepresent your identity or booking details

Jackie may restrict or suspend accounts involved in misuse.

21. Intellectual Property

Jackie owns or has permission to use the Jackie name, logo, website, app, graphics, text, software, designs, features, content, and related intellectual property.

You may not copy, modify, reproduce, distribute, sell, reverse engineer, or exploit Jackie's intellectual property without written permission.

22. User Content

You may submit ratings, reviews, comments, photos, support messages, documents, or other content through Jackie.

You confirm that any content you submit is accurate, lawful, and does not violate anyone else's rights.

By submitting content, you allow Jackie to use, store, review, reproduce, display, and process it for platform operation, support, safety, quality control, marketing, legal compliance, and service improvement.

23. Privacy

Jackie collects and uses personal information as described in our Privacy Policy.

By using Jackie, you agree that Jackie may send service-related messages, including booking confirmations, delivery updates, receipts, safety notices, account notices, and support messages.

Marketing messages may be sent where permitted by law. You may opt out of non-essential marketing.

24. Third-Party Services

Jackie may use or connect with third-party services, including:

• Payment processors
• Mapping providers
• Identity verification tools
• Messaging tools
• Analytics providers
• Cloud hosting services
• Merchants
• Delivery partners
• Transport partners

Third-party terms and privacy policies may also apply.

Jackie is not responsible for third-party services outside Jackie's control.

25. Service Availability

Jackie does not guarantee that the platform or any specific service will always be available.

Services may be delayed, interrupted, limited, or unavailable because of:

• Traffic
• Weather
• Road conditions
• Partner availability
• Technical issues
• Safety concerns
• Legal or regulatory requirements
• Public holidays
• Payment issues
• Events outside Jackie's control

26. Account Suspension or Termination

Jackie may suspend, restrict, or terminate your account if we believe that you:

• Breached these Terms
• Provided false information
• Misused the platform
• Failed payment checks
• Created safety concerns
• Engaged in fraud or abuse
• Harassed a user, partner, or staff member
• Sent prohibited items
• Violated applicable law

You may stop using Jackie at any time. You may also request account closure, subject to any legal, payment, safety, fraud-prevention, or recordkeeping requirements.

27. Disclaimers

Jackie provides the platform and services on an as available basis.

To the fullest extent permitted by law, Jackie does not guarantee that:

• Every booking will be accepted
• Every pickup or trip will be completed
• Estimated times will be exact
• The platform will be uninterrupted or error-free
• Third-party partners will always be available

Nothing in these Terms excludes or limits any right that cannot legally be excluded under Jamaican law.

28. Limitation of Liability

To the fullest extent permitted by law, Jackie will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses, including loss of profit, loss of business, loss of goodwill, loss of opportunity, or loss of data.

Where Jackie is legally responsible for a claim connected to a booking, Jackie's total liability will be limited to the greater of:

• The amount paid for the specific booking connected to the claim; or
• JMD [Insert Amount]

This limitation does not apply where liability cannot legally be limited, including fraud, wilful misconduct, or other liability that Jamaican law does not allow Jackie to exclude.

29. Indemnity

You agree to protect Jackie, its affiliates, directors, employees, agents, and partners from claims, losses, damages, penalties, costs, and expenses arising from:

• Your breach of these Terms
• Your misuse of Jackie
• Your unlawful conduct
• Incorrect booking details
• Prohibited or unsafe items
• Damage caused by you
• Content you submit
• Your violation of another person's rights

30. Complaints and Support

If you have an issue with a booking, delivery, payment, partner, refund, or account, contact Jackie support as soon as possible.

Jackie may ask for details, screenshots, receipts, photos, delivery proof, trip records, or other information to investigate.

31. Dispute Resolution

Before starting legal action, you agree to contact Jackie first so we can try to resolve the issue.

Where appropriate, Jackie may attempt to resolve disputes through support review, internal escalation, mediation, or another reasonable process.

Nothing in these Terms prevents you from contacting a regulator, consumer protection body, or other authority where you have the legal right to do so.

32. Governing Law

These Terms are governed by the laws of Jamaica.

Subject to any mandatory legal rights, disputes connected to these Terms or Jackie's services may be handled by the courts of Jamaica.

33. Changes to These Terms

Jackie may update these Terms from time to time.

If we make important changes, we may notify you through the website, app, email, SMS, push notification, or another reasonable method.

Your continued use of Jackie after the updated Terms take effect means you accept the updated Terms.
